Intellectual property rights are often an overlooked aspect of real estate. They can be an extremely valuable asset to a real estate broker, but if not understood and respected, intellectual property rights can also create potentially dangerous liabilities. A good trademark can help separate your business in the real estate market but is a photograph found on the internet free for you to use? What is the legal status of other listing materials? When purchasing a business, do your commercial buyers understand the potential value of the intellectual property associated with the business?

In this streaming video presentation, James provides an educational overview of the basic laws pertaining to intellectual property and how it relates to real estate.
Following his presentation, James will sit down with Colorado real estate attorney Damian Cox for a Q&A in which the practical side of intellectual property rights and laws and their effect on real estate transactions and real estate brokers are further explored. Mr. Cox provides legal counsel to the agents of some of the largest brokerages in Colorado. His questions are from the prespective of the real estate brokers he advises every day.

Instructor - James Weatherly
Mr. Weatherly is a patent attorney with Cochran Freund &Young LLC. He counsels clients about protecting, enhancing and enforcing their intellectual property rights both in the United States and internationally. He has obtained patents, plant breeders rights, trademarks, copyrights, licenses and set up trade secrets policies. Mr. Weatherly has managed matters in the fields of agriculture, horticulture, biofuels, biotechnology, pharmaceutical, nutrition, telecommunications, mechanical and computer software.
In particular, he has managed a variety of legal matters related to the agriculture and plant industry, including trait based and seed based agronomic patents, plant patents, United States Plant Variety Protection, and Plant Breeders Rights in North America, Europe, Africa, South America, Asia and Australia, as well as Federal Seed Act issues. Mr. Weatherly has successfully prosecuted the registration of trademarks in North America, Europe, Africa, South America, Asia and Australia for the fruit, vegetable, seed crop, horticulture and grass industries. He has also managed the litigation of trademarks in North America, Europe and Asia.
